Supreme Court candidate Khaled Kabub failed to divulge friendship with his lawyer

A joint investigation by Shomrim and Calcalist: One of the candidates for a seat on the Supreme Court – Khaled Kabub – has been friends with attorney Zvika Bar-Nathan since their student days. Recently, Bar-Nathan represented Kabub in the so-called Bramley Affair, and also spoke on Kabub’s behalf on Channel 13’s “The Source.” Nonetheless, Bar-Nathan’s name does not appear on the Kabub’s recusal list. Moreover, the would-be justice is currently hearing several cases involving lawyers from Goldfarb, Seligman and Co., where Bar-Nathan is vice chairman – without providing the sides with due disclosure and in violation of norms and precedents. Kabub’s response: “Hundreds of lawyers work at Goldfarb, Seligman and Co. whom the judge does not know personally and has no relations with. Summary

Judge Khaled Kabub, one of the leading candidates to be appointed to the Supreme Court, and attorney Zvika Bar-Nathan are old friends. They studied law together at Tel Aviv University. Recently, Bar-Nathan even represented Kabub in the so-called Bramley Affair and appeared on a television show as his representative, answering questions in his name.

Despite the years-long friendship and the professional connection between the two, Bar-Nathan’s name does not appear on Kabub’s recusal list. Bar-Nathan himself has not appeared before Kabub, but other lawyers and partners from his law firm have and continue to do so. Kabub, for his part, did not provide the sides in those cases with due disclosure, in violation of all norms and precedents. Three former judges and two legal ethics experts interviewed for his article – without being told the identity of the judge in question – describe his behavior as improper.

Following a query from Shomrim and Calcalist, Kabub added Bar-Nathan to his recusal list, but, in response, insists that he is not obligated to provide due disclosure. “As far as the judge is aware, the Goldfarb, Seligman and Co. law firm employs hundreds of lawyers with whom he has no personal acquaintance and has no relationship. No lawyer from that firm with whom the judge has a relationship outside the courtroom has every appeared before the judge. The judge sees no reason not to hold hearings involving lawyers from Goldfarb, Seligman and Co.”
